Types of Sex Crimes

There are several types of sex crimes that depend on the age of the victim and the nature of the offense.  And there are varying degrees of sex crime charges, which will determine whether it is classified as a misdemeanor, gross misdemeanor, or felony.  Even misdemeanor sex crimes can carry a social stigma and interfere with your life. Charges must be taken seriously to prevent an unjust outcome.

First Degree

The most serious sex crime, this involves sexual penetration involving a number of various scenarios, including sexual conduct with a victim under 13 years old, often with the use of force or violence.

  • The penalty for a conviction is up to 30 years in prison and/or a $40,000 fine.

Second Degree

This involves the same scenarios as a first-degree, except the act is sexual contact, not penetration.

  • The penalty for a conviction is up to 25 years in prison and/or a $35,000 fine.

Third Degree

This involves sexual penetration, like the first-degree, but involves different scenarios, such as the victim being mentally impaired or incapacitated.

  • The penalty for a conviction is up to 15 years in prison and/or a $30,000 fine.

Fourth Degree

It involves the same scenarios as third-degree, but the act is sexual contact, not penetration.

  • The penalty for a conviction is up to 10  years in prison and/or a $20,000 fine.

Fifth Degree

Nonconsensual sexual contact with any person, and other types of lewd behavior.

  • The penalty for a conviction is up to 1 year in jail and/or a $3,000 fine. Though, multiple lewd behavior type offenses can enhance the charge to a felony.

Sexual Assault, Rape, and Child Abuse

In addition, some sex crimes involve actions and contact that are not consensual, or involve young children, including:

Sexual Assault or Rape

Any type of non-consensual contact or sexual activity

Statutory Rape

Sex with a minor under the age of 16, even if they consent, or under the age of 18 if the adult is in a position of authority over them

Sexual Child Abuse

Sexual contact with a child under the age of 13
