Stay of Imposition. Client blew a .19 and got into an accident. She admitted to being drunk when stopped by police. By all accounts, the client had no legal defenses. Yet, with a strong plan of attack, the North Star team achieved this rare outcome on her behalf - OVER the State's objection. In a local city that is known for being tough on clients with high readings, Mr. Gempeler made a compelling argument at sentencing to give the client the chance to earn a misdemeanor disposition after probation. Plea to an amended count of Disorderly Conduct. For a case involving public masturbation in a parked vehicle, avoiding an indecent exposure conviction - as well as any time in custody - was a critical result for the client. Stay of Imposition, with a minimal term in custody. The facts of this case were not pretty in the sense that the client hospitalized his roommate over an innocuous argument. The client rebounded perfectly following the incident by seeking mental health treatment and refocusing his life around supportive family and friends. Due to this, he earned the opportunity to have a misdemeanor conviction following his probationary term. For a young man with a bright future, his regrettable decisions on a single night will not have to define him for life.

Charges: 1st Degree Criminal Sexual Conduct (Felony); 5th Degree Criminal Sexual Contact (Gross Misdemeanor); Two separate juveniled cases with two different victims, incurred over a short period of time in the same county.

The first degree case was amended to a third degree criminal sexual conduct and the client was admitted into the deferred adjudication program. Meanwhile, the client received a stay of adjudication on the fifth degree case, with tracking probations essentially. Literally, this outcome saved this client's life. He now can earn the continued clean record and never be convicted of any offense, despite the serious allegations. The young man took serious and significant strides in his growth and maturation that paid dividends at sentencing. Add in a full account for his wrongdoings and he posed the perfect candidate for this generous and unlikely outcome.

Charges: 4th Degree DWI - Misdemeanor

Stay of Adjudication - which means the case will be dismissed, without a conviction, after a brief probationary period. This is such an incredibly rare outcome. And, on top of the outcome itself, the terms and conditions of probation are exactly in line with a standard first-time offense - i.e. the client does not have to do anything above and beyond to get this incredible outcome. Instead, due to shrewd negotiating, leveraging a pre-trial motion, a terrific relationship with the prosecutor, and, frankly, some luck, the client was able to keep a perfect record, thereby saving his career. Only North Star achieves these type of outcomes with any consistency.

Stay of Adjudication. The client had no criminal record and the allegations could have been charged out as felony sex crimes that would have required registration as a sex offender if proven. With a careful approach and smart negotiations, the client maintains his perfect record, remains on track with his schooling and extra-curriculars, and even was able to stay at the same school - despite the allegations involving transgressions while at school.

What makes this outcome even more remarkable is the client received the same outcome on a damn near identical incident less than a year prior to this incident. Still, with some proactive steps and savvy negotiating, the North Star team obtaining this outcome - even over the victim's objection to it. The client is thrilled to walk away from both incidents without a criminal record.

Charges: Misdemeanor School Stop-Arm Violation

Stay of adjudication. The state initially demanded a plea to the count as charged with a significant fine. After some negotiating, the state reduced its offer to a petty misdemeanor, which is a non-crime and not a bad outcome. Undeterred, the North Star team knew how to leverage a potential contested hearing into an outcome in which the client will earn a dismissal after the one-year probationary period on the stay of adjudication. And the fine remained the same as the original offer. Point being, the North Star team correctly navigated this case to get the client the best possible outcome to avoid creating a criminal record over a traffic matter.
