Traffic Violations Case Results
To see just how successful our approach is, here are some representative results:
State v. S.C.
March, 2023
Charges: School Bus Stop Arm Violation - Misdemeanor
Resolution:
Continuance for dismissal. This is the best possible plea deal one can achieve. The only better outcome is an outright dismissal. And here, there was zero chance of an outright dismissal because the evidence was rock solid. The North Star team was still able to negotiate this fantastic result against a prosecutor that takes these cases serious because of the public safety implications due to our due diligence, strategic approach, and relationship with the prosecutor. Client is thrilled she retained the North Star team to help her through this stressful case.

State v. N.N.
February, 2023
Charges: Reckless Driving - Misdemeanor; Speeding in Excess of 100+ mph
Resolution:
Plea to a petty misdemeanor speeding ticket, amended to 80 mph in a 60 mph speed limit zone. This result accomplishes two key things that were very important to the client: (1) he will not lose his license due to the 100+ mph allegation; and (2) he does not create a criminal record from a traffic matter. Once the North Star team fought to get this outcome on the table, the client quickly scooped it up, realizing how great it is.
State v. T.C.
February, 2023
Charges: School Bus Stop Arm Violation - Gross Misdemeanor
Resolution:
Continuance for dismissal. Even with the presence of children outside the bus, the North Star team (both Mr. Gempeler and Mr. Duffy) achieved this best possible plea negotiation. Usually, these are rare outcomes for a gross misdemeanor offense involving children. Thankfully, we knew how to approach the case, made a strong pitch, and, of course, our strong relationships with the prosecutors once again did not hurt our clients when we advocated on their behalf. What makes this outcome that much more important is that the client will be applying for naturalization in the coming year and this outcome will greatly reduce any impact this could have had on their application.
State v. L.A.
January, 2023
Charges: School Bus Stop Arm Violation - Misdemeanor (but should've been charged as a gross misdemeanor because kids were clearly outside the bus)
Resolution:
Continuance for dismissal. Video existed showing the incident and it was clear as day that the client rolled through the stop sign without stopping when there were kids just outside the bus. About as easy of a case to prove as you get. The North Star team was still able to negotiate this best possible plea deal, one that includes no admission of facts, no adjudication, and no conviction. The client will maintain her perfect record, which exactly what she sought when retaining this firm.

State v. A.D.
January, 2023
Charges: Driving After Suspension - Misdemeanor
Resolution:
Stay of adjudication. The client had a horrible traffic record, which even led to him being identified as a habitual violator by the State DVS. Under those circumstances, obtaining a plea that does not result in a conviction is rare. But, the North Star team pushed, advised the client on how to get valid, and was finally able to get this outcome, one that was absolutely needed for the client.

State v. R.G.
November, 2022
Charges: Misdemeanor School Bus Stop Arm Violation
Resolution:
Continuance for dismissal. The client had no defense, but we were able to obtain the best possible plea deal. The State started with a worse offer, which was still good, but the North Star team pushed back and kept fighting for this even better one. Point being, even on what might be considered "simple" traffic cases, we don't roll over and take the first good offer; we continue fighting and do our damnedest to get the best possible deal for every client.

State v. W.S.
November, 2022
Charges: Reckless Driving and Speeding in Excess of 100+ - both misdemeanors
Resolution:
Continuance for dismissal. Obtaining this incredible outcome (literally cannot get a better negotiated outcome) is even more remarkable considering how tough it is to get or something slightly worse on just a reckless driving or speeding ticket. But, when both charges are present, this type of outcome is almost unheard of. Working to our benefit is that the officer was a bit aggressive including the reckless driving charge. Arguing this to a prosecutor who agreed with us presented the unique opportunity to push for this fantastic result. And considering a co-defendant received a worse outcome, the client is thrilled he chose North Start to fight for him.
State v. D.M.
October, 2022
Charges: Reckless Driving, including one count of reckless driving, street racing; Careless Driving - Misdemeanors
Resolution:
Stay of adjudication to the reckless driving count, with the other street racing reckless and careless driving counts dismissed. The client has a minimal fine and cannot have any careless or reckless offenses for one year in order to earn the non-conviction for this serious case. The facts were not good, to put it nicely. They involved an accident where the client's passenger was hurt and an allegation that street racing was occurring. The combination of which is often damn near impossible to overcome. Undeterred, the North Star team pushed and was creative in negotiations, including leveraging the possibility of trial, to achieve this incredible outcome.
State v. L.X.
July, 2022
Charges: Careless Driving - Misdemeanor
Resolution:
Stay of adjudication in this juvenile matter involving a serious accident caused by the client. With no defenses because there was home security video showing the accident, the North Star team still achieved this fantastic result - one which the Court recognized was about as good as she could've received under the circumstances. The client was a high school student who was already taking college courses and has a very bright future. So avoiding a criminal conviction was critical and that's exactly what we achieved.
State v. P.T.
June, 2022
Charges: Speeding Ticket - Petty Misdemeanor (31 mph over the posted limit)
Resolution:
Stay of adjudication. This was an absolutely critical outcome for the client. Any moving violation conviction on his record could lead to employment termination due to him being on the road regularly for work. And with the alleged speed being so much above the posted limit, this seemed like a daunting task and posed to be one initially. But, the North Star team kept after it and continued negotiating with the State to get this needed result after much deliberation.
