State v. A.B.
April, 2024
Charges: Felony Domestic Assault by Strangulation; Misdemeanor domestic assault
Resolution:
Plea to an amended count of fifth degree assault (non-domestic in name). What's more, the sentence included no time to serve, a minimal fine, and otherwise simple terms and conditions of probation for only one year. Considering the client's child witnessed the alleged strangulation, obtaining this non-felony, non-custody outcome is incredible. The client did everything asked of Mr. Gempeler following the incident - obtaining a chemical dependency assessment, achieved provable sobriety, and complied with his alcohol monitoring. The client's wife - the victim - remained supportive and helped explain the critical impact alcohol had in the overall situation. And after everything, the client is able to move forward with his life in the best position possible following such a regrettable mistake.

Charges: 3rd Degree Assault - Felony; Illegal Deployment of a Chemical Weapon - Felony
Resolution:
Case dismissed on the day of trial. Mr. Adkins convinced the State its challenges were too great, removing the need to consider a felony plea and possible jail time. The client is overjoyed, and has already obtained a full expungement of this matter, erasing a year of utter torment and needless worry. Charges: 3rd Degree Drug Possession by a School/Park - Felonies; Felony fleeing of a motor vehicle; obstructing legal process as a gross misdemeanor
Resolution:
Stay of adjudication to both the drug charge and fleeing in a motor vehicle. The end result - upon the successful completion of probation - is a complete dismissal of the entire case. This is a remarkable outcome due to the nature of the allegations, the fact the officers were not a fan of the client due to the alleged obstruction, and this was achieved in a notoriously challenging County against drug-related offenses. Despite these obstacles, Mr. Gempeler worked hard on the prosecutor to get this needed outcome that avoids both any felony convictions and the possible lengthy loss of license that comes from a felony fleeing conviction. Given that there were no defenses to these charges, obtaining this outcome was tough sledding, but one that the North Star team routinely achieves for its clients.

Charges: 8 counts of felony tax crimes
Resolution:
Plea to three amended gross misdemeanor tax counts for failing to file sales tax returns in specific quarters. The client was without an actual defense for failing to file or pay sales tax for a business he ran. Worse, he had never done so. While he didn't intend to do so because of a poor understanding of his tax obligations, convincing a jury of tax-paying citizens otherwise would be tough sledding, to say the least. Still, he could not have a felony conviction on his record or he'd be rejected from entering Canada to visit family. Through lengthy negotiations and litigation, the North Star team finally achieved a gross misdemeanor outcome for the client. On top of that, the sentence includes no jail, a minimum fine, and simply cooperating with the tax audit by the Dept. of Revenue and pay off what is owed.

Charges: Felony Drug Charges
Resolution:
Dismissal. Client was charged with drug possession stemming from a routine traffic stop turning into a full search of his vehicle due solely to the odor of marijuana. With cannabis being legal in various forms, the mere odor of it does not permit a full vehicle search - as dictated by the Minnesota Supreme Court. On the day of the contested hearing, the State rightfully dismissed the case after it realized there was no basis to otherwise justify the search and subsequent discovery of the narcotics. Another fantastic win for the North Star team.

September, 2023
Charges: 5th Degree Controlled Substance - Felony; Theft - Felony
Resolution:
Stay of adjudication - no conviction upon successful completion of probation. The client was accused of misappropriating prescription drugs from a nursing home she worked at. Thankfully, she responded the right way by understanding and addressing her addiction that led to this case. By doing so, the North Star team was able to obtain this fantastic outcome - one that is common for a first-time felony drug case, but can be elusive when the allegations include stealing of prescription medications from a workplace. The North Star team emphasized the client's proactive steps and leveraged our good relationships with the prosecutors to secure this needed and deserving outcome.

Charges: 3rd Degree Assault - Felony
Resolution:
Plea to an amended misdemeanor count of fifth degree assault and the client was placed on unsupervised probation and ordered to pay the bare minimum fine. The client faced not only serious felony consequences, but also steep immigration consequences should he have been convicted of a felony. Thankfully, the North Star got to work, leveraged possible defenses, and negotiated this incredible result - one that accomplishes all the goals the client had ... and then some.

Charges: Domestic Assault - Strangulation - Felony; Misdemeanor domestic assault
Resolution:
Dismissed and pled guilty in a subsequent case where he was charged with another domestic assault, but received a stay of adjudication on an amended count of fifth degree assault. With two cases that included a felony strangulation charge and two separate domestic assault incidents, the client is thrilled to walk away with an outcome that results in no convictions on his record. The North Star team litigated a novel issue and was successful in getting a Court to permit at trial evidence of prior false accusations by the complainant. After winning that motion, the State folded the felony case and offered the non-conviction outcome to a client that was prepared to go to trial. But, even he knew he couldn't turn down this incredible offer and ability to eliminate the risk that comes with a trial.

Charges: 5th Degree Drug Possession - Felony; domestic assault - Misdemeanor
Resolution:
Stay of adjudication to both counts, meaning the client will not be convicted of anything following this incident so long as he complies with minimal and easy terms of probation for just one year. The client had zero defense, as his ex-spouse's therapist witnessed the incident via a zoom meeting. Despite the evidence completely working against him, proactive steps and the thoughtful approach from Mr. Gempeler yielded this critical and incredible outcome for a deserving client.

May, 2023
Charges: 3 counts each of: Attempted 2nd Degree Murder; 1st Degree Assault; 2nd Degree Assault with a Dangerous Weapon
Resolution:
Acquittal at trial on ALL nine counts. A vigorous case led to a trial that spilled in to a second week. The North Star team fought tooth and nail the entire case and prepared a strong self-defense and defense of others defense. While the video evidence supported these affirmative defenses, ultimately defending 13 bullets and two innocent minor bystanders getting hit is no easy task. But, Mr. Adkins and Mr. Gempeler were up to the task. After the case was submitted, the jury deliberated for only 3 hours (including the lunch hour) before returning Not Guilty verdicts on all nine counts. The client and his family got the justice he so rightfully deserved and they are thrilled they had the North Star team fighting for them when they needed it the most.
