Domestic assault by strangulation is one of the more serious and often misunderstood charges in Minnesota criminal law. It comes up more frequently than many people expect, yet there remains widespread confusion about what legally qualifies as “strangulation” and how someone can be charged with a felony even in the absence of visible injuries.

What is Domestic Assault by Strangulation and Why Is It Taken So Seriously?

Under Minnesota law, “strangulation” occurs when a person intentionally impedes another individual’s normal breathing or blood circulation by applying pressure to the neck or throat, or by blocking the nose or mouth. When the alleged victim is a family or household member, the offense is elevated to domestic assault by strangulation, a felony carrying potential penalties of:

  • Up to three years in prison
  • A fine of up to $5,000
  • Or both

If that sounds severe, it is by design. Strangulation is not treated as just another form of assault. Medical research has consistently identified it as a significant predictor of future lethal violence. Loss of consciousness can occur within seconds, and continued pressure can lead to death in a matter of minutes. Studies have also found that prior non-fatal strangulation is present in a substantial percentage of domestic homicide cases.

In other words, the law does not wait for the worst-case scenario to take these allegations seriously.

No Marks, No Case? Not Quite.

Here’s where many people are caught off guard: visible injury is not required. In fact, research indicates that a significant number of strangulation victims show little to no external signs of injury. From a legal standpoint, that is not a loophole, it is anticipated. The statute focuses on whether breathing or circulation was impeded, not whether bruising or marks appear afterward.

Translation: a case can move forward and even result in a conviction without photographs, medical records, or dramatic physical evidence. Instead, these cases often hinge on:

  • Testimony from the alleged victim
  • Statements made at the scene
  • Body camera or recorded evidence
  • Medical observations, if available

Minnesota law permits a conviction based on the testimony of a single credible witness, even in the absence of corroborating physical evidence (State v. Foreman, 680 N.W.2d 536 (Minn. 2004)).

For the defense, that shifts the focus. When the evidence is largely narrative, the case becomes about credibility, consistency, and careful scrutiny of the facts, not just what is visible.
